August 17, 2026: The US Department of State made its US visa bond program permanent this month, and the loudest alarm isn’t coming from the 50 countries it targets – including four in the Caribbean – but it’s coming from America’s own travel industry. US Travel Association President Geoff Freeman told Reuters the bond would have an extraordinarily detrimental effect on the U.S. economy, on the travel industry.”

What changed, and who’s affected

The program, first launched as a 12-month pilot in August 2025, became a standing regulation with no expiration date on August 3. Under the rule, the bond can be forfeited if a traveler overstays or violates ​other conditions of their status. But consular officers can now require B-1/B-2 visa applicants from listed countries to post refundable bonds of $10,000 to $20,000, with $15,000 as the expected default, up from the pilot’s $5,000-$15,000 range. Among the four Caribbean nations named are Antigua and Barbuda, Dominica, and Grenada, all Citizenship by Investment jurisdictions. Saint Kitts and Nevis and Saint Lucia, which run comparable CBI programs, are not currently on the list.

The rule carries real teeth. Filing for asylum triggers automatic bond forfeiture. Even a legitimate visa extension or status change request can count against a traveler in USCIS’s discretionary review, bond or no breach. Entry and exit are restricted to major commercial airports only.

The administration’s case, and the industry’s rebuttal

The State Department points to real numbers behind the decision: overstays from those same countries dropped from 45,488 in fiscal 2024 to fewer than 50 during the pilot period. But the bigger issue is that visa issuances in pilot countries fell by 83% in the program’s first 10 months, meaning the US is also losing money.

Freeman argues the administration is solving a narrow problem while creating a much bigger one. The countries currently covered account for less than 2% of visitors to the US, he noted, even as the broader travel industry is already absorbing a 25% decline in visitors from Canada, and Asian travel is running at half of 2019 levels. Total overseas travel to the US fell 4.3% year-to-date through June, including a 1.8% drop during the same month the country hosted the World Cup.

“If we can’t have year-over-year increases in travelers during the World Cup, which we didn’t, what the heck are we going to do in an average September?” Freeman said.

What it means for CBI investors

For citizens of Antigua and Barbuda, Dominica, and Grenada who obtained citizenship through investment, Washington’s message is now permanent, not experimental. The original pilot rule explicitly listed Citizenship by Investment obtained without a residency requirement as a qualifying criterion for inclusion; the permanent rule folds that into broader language about “the security of travel and civil documents, including in the granting of citizenship,” without naming CBI directly, though the practical effect on the same four countries remains unchanged.

Worth watching, though not yet confirmed: the same legal authority underpinning this program, Section 221(g)(3) of the Immigration and Nationality Act, also extends to F-1 and J-1 student visas. The State Department has made no announcement of expansion there, but DHS has separately finalized a rule eliminating “duration of status” protections for those same visa types, effective September 15.

Other Details To Know

Can I apply for a Public Charge Bond now?

How much is a Public Charge Bond?
Pursuant to 8 CFR 213.1(b), a consular officer sets the amount of the bond.  Consular officers will set bond amounts based on an assessment of the totality of the circumstances of each case.  

Does this affect my current valid visa?
No.  This does not affect any currently valid visas.
