16 December 2022 – The Ministerial Conference of the Organisation for Economic Co-operation and Development (OECD) Digital Economy Committee has adopted the Declaration on Government Access to Personal Data Held by the Private Sector. The adoption took place in the framework of the conference on the digital economy, held this week in Gran Canaria.
The document, in the drafting of which the Spanish Ministry of Justice led by Pilar Llop participated, shows the commitment of the signatory countries to ensure that government access to data held by the private sector complies with personal data protection standards, thus facilitating the international flow of personal data, and reinforcing legal certainty and mutual trust between the signatory countries.
It also aims to ensure that the prevention, investigation and prosecution of crime is carried out in the framework of cross-border cooperation to strengthen access to available information, including information of a personal nature, thus ensuring common standards of privacy protection.
Furthermore, the declaration envisages a common framework of guarantees of democratic principles and respect for the rule of law, so that both areas of protection can coexist in balance: public security and the guarantee of citizens’ rights, with the protection of personal data.
The conference, which was chaired by the First Vice-President of the Government and Minister for Economic Affairs and Digital Transformation, Nadia Calviño, was attended on behalf of the Ministry of Justice by the Undersecretary, Ana Sánchez.
